KalorIQ Terms of Service
Effective date: September 4, 2026 · Last updated: October 7, 2026
The short version. KalorIQ is a nutrition-tracking app, not a doctor. The numbers it shows are estimates. You must be 16 or older. Subscriptions are billed and refunded by Apple. What you post is yours, but you give us permission to show it to the people you share it with. Nutrition data you contribute for unknown barcodes becomes part of a shared database. Don't be abusive. We can suspend accounts that break these rules. Texas law applies. The full terms below control.
1. Who We Are and What These Terms Cover
These Terms of Service (the "Terms") are an agreement between you and KalorIQ ("KalorIQ", "we", "us"), based in Texas, United States. They govern your use of the KalorIQ iOS application, its widgets and extensions, the KalorIQ website at kaloriq.com, and the services, content, and features we provide through them (together, the "Service").
By creating an account or using the Service you agree to these Terms and to our Privacy Policy, which explains what data we collect and how we use it. If you do not agree, do not use the Service.
The KalorIQ app is downloaded from the Apple App Store and is also licensed to you under Apple's Licensed Application End User License Agreement (the "Apple EULA"). Where these Terms and the Apple EULA conflict about the software license itself, the Apple EULA controls; for everything else about your account, content, and the Service, these Terms control.
2. Not Medical Advice
KalorIQ is for general wellness and informational purposes only. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for a physician, registered dietitian, or other qualified health professional.
Calorie and macronutrient targets, energy-expenditure estimates, adaptive target adjustments, weight projections, insights, and every other number the Service shows you are estimates produced by general formulas and your own logged data. They can be wrong for you. Do not use the Service to diagnose or treat any condition, and consult a health professional before starting or changing a diet or exercise program, especially if you are pregnant or breastfeeding, under medical supervision, taking medication that affects appetite or weight, or have or have had an eating disorder. Stop using the Service and seek professional help if tracking your food is harming your relationship with eating. In an emergency, call your local emergency number.
3. Who May Use KalorIQ
- You must be at least 16 years old. The app asks for your date of birth and will not create an account below that age. If we learn an account belongs to someone under 16 we will close it.
- You must provide accurate information and keep it current. One person, one account.
- You are responsible for your device, your Apple ID, and everything that happens under your KalorIQ account. Tell us at support@kaloriq.com right away if you think your account has been used without your permission.
- You may not use the Service if you are barred from doing so under the laws of your country.
4. Your Account
4.1 Creating an account
You can sign up with an email address and password or with Sign in with Apple. Email accounts require verification. Your username is visible to other users; choose one you are comfortable sharing.
4.2 Deleting your account
You can delete your account at any time inside the app (More → Settings → Privacy → Delete Account). Deletion has a 30-day grace period: signing in again within 30 days cancels the request and restores your account. After 30 days your account and personal data are permanently erased as described in the Privacy Policy. Deleting your account does not cancel an Apple subscription by itself; see Section 6.4.
4.3 Suspension and termination by us
We may suspend or terminate your account, remove content, or restrict features if you breach these Terms, if required by law, to protect other users or the Service, or if the account has been inactive for an extended period after notice. Where reasonable we will tell you why and give you a chance to export your data. Sections that by their nature should survive termination (including Sections 2, 7, 8, 11, 12, 13, and 14) survive.
5. The Service and Its Data
5.1 Nutrition data
Food and nutrition information in the Service comes from third-party databases and licensed providers, from package labels scanned by users, and from information contributed by the KalorIQ community. We work to keep it accurate but we do not guarantee that any food entry, barcode match, label scan, serving size, or nutrient value is correct or complete. Manufacturers change formulations, labels are read by on-device text recognition that can misread values, and community entries are supplied by other users. Always check an entry against the actual package, especially if you have an allergy, intolerance, or medical dietary restriction. Allergen and diet-conflict warnings in the app are a convenience, not a safety system, and can miss ingredients.
5.2 Apple Health
If you choose to connect Apple Health, the Service reads and writes the data types you approve in the Health permission sheet. We use Health data only to provide the Service to you, as described in the Privacy Policy. You can change or revoke Health permissions at any time in the Health app, and the Service will keep working with whatever data you allow.
5.3 Automated targets and insights
KalorIQ calculates targets from standard formulas, your profile, and your logs. If you opt in to adaptive targets, your calorie target may change automatically, on a schedule, based on your recent weight and intake data. Weekly recaps, insights, achievements, and reminders are generated automatically and are informational only. You remain responsible for deciding what to eat.
5.4 Changes to the Service
We are a small team building an evolving product. We may add, change, or remove features, integrations, and data sources, and may impose reasonable limits on storage or usage. We will try to give notice of changes that materially reduce the Service, and you may cancel as described in Section 6.
5.5 Availability
We aim for the Service to be available at all times but do not guarantee it. Maintenance, outages, App Store changes, or events outside our control may interrupt it. Some features need an internet connection.
6. Subscriptions, Trials, and Payment
6.1 KalorIQ Premium
The KalorIQ app is free to download. Using the Service beyond the free trial requires KalorIQ Premium, currently offered as a monthly subscription, an annual subscription, a Family subscription (section 6.9), or a one-time Lifetime purchase (section 6.8). Prices are shown in the app in your local currency before you buy and may change; for subscriptions, any change applies only to renewals after we give you notice through Apple.
6.2 Free trial
New subscribers get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, the subscription you selected starts automatically and Apple charges your payment method. One trial per Apple ID; creating extra accounts to obtain additional trials is not allowed.
6.3 Billing through Apple
All subscriptions are purchased through Apple's in-app purchase system and are charged to your Apple ID. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. Apple's terms and payment policies apply to every purchase.
6.4 Cancelling
Cancel at any time in your iPhone Settings → your name → Subscriptions → KalorIQ, or from More → Subscription in the app. Cancelling stops future renewals; you keep access until the end of the period you already paid for. Deleting your KalorIQ account or the app does not cancel the subscription; you must cancel it with Apple.
6.5 Refunds
Because Apple processes every payment, refunds are handled by Apple under Apple's refund policy, not by KalorIQ. Request one at reportaproblem.apple.com. We are unable to issue refunds ourselves, and, to the extent permitted by law, subscription fees are non-refundable except as Apple decides.
6.6 Referral rewards and other complimentary access
We may grant complimentary Premium access, for example a free month for you and a free month for a friend once a friend you invite subscribes and Apple processes their first payment. Referral rewards are a benefit of the monthly KalorIQ Premium plan: they are delivered as App Store offer codes redeemable against the monthly subscription, and only members with an active monthly subscription at the time the reward is issued are eligible to receive one. Complimentary access is a courtesy, not a purchase: it has no cash value, cannot be transferred or exchanged, is subject to the caps and anti-fraud rules described in the app, and can be adjusted or withdrawn if we detect abuse such as self-referrals, fake accounts, or automated sign-ups. Complimentary time runs alongside, not instead of, any paid subscription, and ends when the account is deleted.
6.7 Restoring purchases
Your subscription or Lifetime purchase follows your Apple ID. On a new device, sign in to KalorIQ and tap Restore Purchases on the subscription screen.
6.8 Lifetime access
KalorIQ Premium Lifetime is a one-time in-app purchase that gives you Premium access for as long as we offer the KalorIQ product, with no renewals. “Lifetime” means the life of the product, not the life of the purchaser: if we permanently discontinue KalorIQ, Lifetime access ends with it, and we may retire or replace individual features over time as described in section 5. Lifetime access is tied to the Apple ID that bought it and the KalorIQ account it was activated on, is not shared with other people or accounts, and is not transferable. Because Apple processes the payment, refunds follow section 6.5; a refunded Lifetime purchase ends your access on the date Apple issues the refund. Buying Lifetime does not cancel any KalorIQ subscription you already hold with Apple — cancel that subscription in your iPhone Settings, otherwise it keeps renewing.
6.9 Family plans
KalorIQ Premium Family is a monthly or annual subscription that the purchaser shares with the members of their Apple Family Sharing group (up to five additional people) through Apple's Family Sharing feature. Each family member uses their own KalorIQ account and keeps their own data; sharing the subscription does not share anyone's food log, weight, or other personal information. Who is in the family group, and whether the subscription is shared with them, is controlled by the purchaser through Apple, not by KalorIQ. When a member leaves the family group, the purchaser stops sharing, or the subscription ends or is refunded, that member's Premium access ends at the same time. Only the purchaser can cancel or change a Family subscription (section 6.4); family members are not billed and cannot manage it from their accounts. Referral rewards (section 6.6) are not available on Family plans, and a person who joins KalorIQ through a family member's plan does not count as a referred subscriber.
7. Your Content
7.1 What you own
You keep ownership of everything you create in KalorIQ: your logs, recipes, meal plans, progress and meal photos, posts, comments, and profile ("Your Content").
7.2 The permission you give us
So that we can run the Service, you grant KalorIQ a worldwide, non-exclusive, royalty-free license to host, store, back up, process, reproduce, adapt (for example resizing a photo), and display Your Content, but only for the purpose of operating, securing, and improving the Service and only to the extent of the visibility you choose. Content you keep private is shown to you alone. Content you share to the social feed or with friends is shown to the audience you selected, who may view it in the app for as long as it stays shared. This license ends when you delete the content or your account, except for copies in routine backups that expire on their own schedule and content other users have already re-shared within the Service.
7.3 Community food contributions
When you scan a nutrition label or enter nutrition facts for a barcode the Service does not recognise, that nutrition information (the product name, brand, serving sizes, and nutrient values, but not your identity, photos, or logs) is added to KalorIQ's shared community food database so the next person who scans that barcode finds it. Because this reference data is useful to everyone, you grant KalorIQ a perpetual, irrevocable, worldwide, royalty-free license to use, store, correct, combine, and distribute community nutrition contributions as part of the Service, and the contribution is de-identified and remains in the database after you delete your account. Please contribute only accurate information from the actual package. We may review, edit, replace, or remove contributions at any time.
7.4 Your responsibilities for Your Content
You are responsible for Your Content and confirm that you have the rights to share it and that it does not violate Section 8 or anyone else's rights. We do not pre-screen content but may review, remove, or restrict it as described in Section 8.
7.5 Feedback
If you send us ideas or suggestions, we can use them without obligation to you.
8. Community Rules
KalorIQ has a social feed, comments, friends, and shared recipes. To keep it a place that helps people, you agree not to post or do any of the following:
- Harass, bully, threaten, or demean anyone, including comments about another person's body, weight, or food.
- Promote or glamorise disordered eating, extreme restriction, purging, or dangerous weight-loss practices, or share "tips" for them.
- Give medical advice you are not qualified to give, or present supplements, drugs, or diets as cures.
- Post sexual, violent, hateful, or illegal content, or content that infringes someone else's copyright, trademark, or privacy.
- Impersonate anyone, misrepresent your affiliation, or share another person's private information.
- Spam, advertise, run contests, or solicit without our written permission.
- Upload malware, scrape or harvest data, probe or overload our systems, reverse-engineer the app, or access the Service by automated means or through anything other than the app and website we provide.
- Create multiple accounts, fake accounts, or accounts for others; evade a block or suspension; or manipulate referrals, achievements, or the community food database.
Content checks. Before your username, profile name, posts, comments, shared meal names, published recipes, and foods you add to the shared database appear to others, they are checked automatically: first against a list of blocked words, then by our moderation provider, TypeSafe AI. Profile, meal, post, and recipe photos are checked by Amazon Rekognition before they are published. Text or photos that break these rules are not published; you can revise the text or choose a different photo. You agree to these checks when you create an account; older accounts are asked in the app and need to agree before they post, comment, publish a recipe, add a food or a photo, or change their name. Sections 2.9 and 2.10 of the Privacy Policy explain what is sent.
Tools for you. Every post and comment has a Report option (spam, inappropriate, harassment, misinformation, other). You can block or mute any user, and control who sees each thing you share. Reports go to us and we act on them.
What we may do. We may remove or hide content, limit features, or suspend or terminate accounts that break these rules, with or without notice depending on severity. We may also preserve and disclose content where the law requires it or to protect someone's safety. Decisions about content are ours to make in good faith; you can appeal by emailing support@kaloriq.com.
9. Notifications and Communications
The Service can send you push notifications and local reminders (meals, water, bedtime, goal check-ins, weekly recaps) that you control in the app and in iOS Settings. We will send account and service emails such as verification, password reset, security alerts, and material changes to these Terms; you cannot opt out of those while you have an account. Marketing emails, if any, always include an unsubscribe link.
10. KalorIQ's Intellectual Property
The Service, including the app, website, design, text, graphics, logos, the KalorIQ name and marks, our food database compilations, and the software behind them, belongs to KalorIQ or its licensors and is protected by copyright, trademark, and other laws. Subject to these Terms we grant you a personal, limited, non-transferable, revocable license to install and use the app on Apple devices you own or control, as permitted by the App Store terms, for your own non-commercial use. You may not copy, modify, distribute, sell, rent, sublicense, or create derivative works from any part of the Service, remove any notices, or use our name or marks without permission. Nutrition data from third-party providers is licensed to us and may carry its own attribution and usage restrictions.
11. Third-Party Services
The Service depends on services we do not control, including Apple (App Store, in-app purchase, Sign in with Apple, HealthKit, push notifications), nutrition-data providers, email and infrastructure providers, and links or recipe imports from other apps and websites. Their availability and terms are theirs, not ours, and we are not responsible for third-party content you reach through the Service. Recipes you import from other sites via the share extension remain subject to those sites' terms.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING SECTION 2, WE DO NOT WARRANT THAT ANY NUTRITION DATA, TARGET, ESTIMATE, INSIGHT, OR RESULT IS ACCURATE, COMPLETE, OR SUITABLE FOR YOU, OR THAT USING THE SERVICE WILL PRODUCE ANY PARTICULAR HEALTH, WEIGHT, OR FITNESS OUTCOME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KALORIQ AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY US DOLLARS (US). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR GROSS NEGLIGENCE.
14. Indemnity
You agree to defend, indemnify, and hold harmless KalorIQ and its owners, employees, and contractors from any claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or third-party right. We may take over the defence of any matter subject to indemnification, and you agree to cooperate.
15. Disputes, Governing Law, and Arbitration
15.1 Talk to us first
Most problems can be fixed quickly. Before starting any formal proceeding, email support@kaloriq.com with a description of the issue and give us 30 days to resolve it.
15.2 Governing law
These Terms and any dispute between you and KalorIQ are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules, except where the consumer-protection law of your place of residence gives you rights that cannot be waived.
15.3 Arbitration and class-action waiver (United States residents)
If you live in the United States and we cannot resolve a dispute informally, you and KalorIQ agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek an injunction for infringement or misuse of intellectual property. The arbitration will be conducted in English, by video or in the county where you live, and the arbitrator's decision may be entered in any court. The Federal Arbitration Act governs this section. You and KalorIQ each waive the right to a jury trial and to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing support@kaloriq.com with your username and the words "arbitration opt-out" within 30 days of first accepting these Terms; opting out does not affect any other part of the Terms. If the class-action waiver is found unenforceable for a particular claim, that claim must be heard in court, and the rest of this section still applies to all other claims.
15.4 Courts
For anything not subject to arbitration, you and KalorIQ agree to the exclusive jurisdiction of the state and federal courts located in Texas, except that residents outside the United States may also bring claims in the courts of their home country where the law gives them that right.
16. Apple-Specific Terms
Because you downloaded the app from the App Store: these Terms are between you and KalorIQ only, not Apple; Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any warranty you may notify Apple and Apple may refund the purchase price, and to the maximum extent permitted by law Apple has no other warranty obligation; KalorIQ, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal-compliance, and consumer-protection claims, and any claim that the app infringes a third party's intellectual property; you represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country and are not on any US government list of prohibited or restricted parties; you must comply with applicable third-party terms when using the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to These Terms
We may update these Terms as the Service and the law change. For material changes we will give you notice in the app or by email at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. The "Last updated" date at the top shows the current version. Continuing to use the Service after a change takes effect means you accept it; if you do not, cancel your subscription and stop using the Service before that date.
18. General
- Entire agreement. These Terms, the Privacy Policy, and any in-app notices we reference are the whole agreement between you and KalorIQ about the Service.
- Severability. If any part of these Terms is held unenforceable, the rest remains in effect and the unenforceable part is replaced with the closest enforceable term.
- No waiver. Not enforcing a term is not a waiver of it.
- Assignment. You may not transfer your account or these Terms. We may assign them to a successor that takes over the Service, and will tell you if we do.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Export. You agree to comply with US export laws in your use of the app.
- Language. These Terms are written in English; translations are for convenience and the English version controls.
